Ohio Statute on Last Paychecks

Ohio law states that if an employee is fired or quits, he or she must be paid by the first of the following month for wages earned in the first half of the prior month and by the 15th of that month for wages earned in the second half of the prior month. This does not include any vacation that may need to be paid.

This can often be confusing for both employees and employers. Many employers are not intentionally breaking the law by withholding your check; most are ignorant of the laws that govern last paychecks. Employers may believe that continuing to distribute funds on the usual pay schedule is sufficient. However, that is not the case. The employer may be held liable and responsible for additional compensation if found to be in violation of the last paycheck laws.
